It Is Impossible For A Single Man To Denude And Rape Without Scuffle : The Bombay High Court

The Bombay High Court’s single bench of Justice Pushpa Ganediwala ruled that it is impossible for a single man to denude and rape without scuffle.
High Court acquitted a 26 year old man saying there would have been a scuffle, if it been a forcible intercourse case. No injury could be seen in medical reports, said Justice Ganediwala.
The Judge said, the defence of consensual physical relations does appear probable.
Prosecution does not inspire the confidence of the Court, she added.
The accused is the neighbour of the victim. It seems impossible that a single man gagged the victim’s mouth, removed her clothes and his clothes and forcibly perform sexual act without any scuffle, a single bench of Justice Pushpa Ganediwala gave the judgement.
This is the third verdict of The Bombay High Court’s Justice Ganediwala.
Earlier, The Supreme Court stayed one of her verdict of groping without skin-to-skin contact is not Sexual Assault.
One another judgement of hers said, holding hands and opening Pant Zip of Minor does not falls POCSO Act.
